As emotionally draining as a divorce can be, some couples find there is a financial toll as well. It’s not uncommon for partners to be worse off after their assets have been divided up and any maintenance agreed, and there are costs that all couples will incur during the process of a divorce.

How much does a divorce cost?
Apart from the fees that most solicitors will charge to deal with a divorce in England and Wales, there are various standard court costs that you will have to pay as a part too.

Divorce court costs – The fee for filing your petition for divorce is currently set at £340, when you file for your Decree Absolute there is a further cost of £40. Depending on your situation, other court charges may apply, such as a fee for a Consent Order, which costs £45 and will be required if you have already agreed the details of the financial settlement and want a ‘clean break’ Divorce.

Solicitor Costs – The cost of a divorce solicitor will vary from case to case depending on the time that it takes to finalise your divorce, the complexity of the case and the solicitors hourly rate. A straightforward case might only cost a few hundred pounds, whereas a long and drawn out process, where a couple are finding it hard to reach an agreement over issues like money and child custody, might cost thousands.

It’s only natural to want to try and keep your costs as low as possible, which may mean choosing one of the less expensive solicitors to represent you; but this might not always be the best option. A more expensive solicitor might well have more experience and knowledge that’s relevant to your particular situation, making the process quicker and a lot smoother.

Legal Aid Divorce
In some circumstance, it may be possible to receive Legal Aid to help cover the cost of your divorce. Legal Aid isn’t available to everyone, but it is one option you could consider when thinking about how to finance your divorce.
